Acceptable Use Policy

This Policy forms part of the DoubleServers Terms of Service. It sets out what may not be hosted on or done with rented servers, how complaints are handled and what measures are applied to violators.

1. General Provisions

1.1. This Policy applies to all DoubleServers customers and to all services: virtual and dedicated servers, additional IP addresses, backups, attack protection and other services, as well as to any person who has obtained access to a server with the knowledge or through the fault of the customer.

1.2. The customer is responsible for everything that happens on their server, including the actions of third parties who have obtained access to the server and the actions of software installed by the customer.

1.3. Servers are hosted in data centres in Europe (Germany, France, Finland, Poland and others), including on the infrastructure of the upstream providers Hetzner, OVH and Contabo. In addition to this Policy, the customer must comply with the laws of the country where the server is hosted and with the rules of the respective provider.

1.4. Ignorance of this Policy does not relieve the customer of liability. The current version is always available at https://doubleservers.com/legal/aup.

1.5. If a provision of this Policy conflicts with a mandatory rule of applicable law, a court order or a requirement of a competent authority, the law prevails.

2. Prohibited Content and Activities

2.1. It is prohibited to host, store, transmit or distribute the following using DoubleServers services, or to engage in the following:

Infringement of third-party rights

  • materials that infringe copyright and related rights, trademarks, patents or other protected rights;
  • unlicensed software, activation keys, tools for circumventing technical protection measures ("cracks", "keygens", "patches");
  • personal data obtained unlawfully: leaked databases, the results of unauthorised collection ("scraping"), doxxing materials — publication of addresses, phone numbers, documents and other data for the purpose of harassment or causing harm.

Malicious activity and cyberattacks

  • unauthorised access to third-party systems, accounts, databases or networks;
  • development, storage, distribution or control of malicious software: viruses, trojans, spyware, ransomware, botnets, command-and-control (C2) servers;
  • denial-of-service attacks (DoS/DDoS), participation in them or provision of resources for them, including stress testers and "booters";
  • phishing: fake pages of banks, payment systems, government bodies, email services, social networks and other services; theft of credentials;
  • scanning of third-party networks and systems without the permission of their owner, password brute-forcing, exploitation of vulnerabilities for unlawful purposes;
  • forging of network identifiers (IP spoofing), concealment of the source of malicious traffic.

Fraud and financial violations

  • resources used for fraud, fictitious investments, deception of consumers, "scam" projects;
  • participation in money laundering schemes or the financing of criminal activity;
  • production and distribution of forged documents, identity cards, bank cards;
  • carding, trade in stolen payment data and accounts.

Illegal and dangerous content

  • any material depicting the sexual exploitation of minors — removed immediately, with information passed to the competent authorities without prior notice to the customer;
  • calls for violence, terrorism, extremism, incitement of hatred on racial, national, religious or other grounds;
  • instructions for the manufacture of weapons, explosives, narcotic substances; trade in items and substances whose circulation is prohibited or restricted;
  • materials whose distribution is prohibited by a court decision that has entered into force or by another binding act.

Spam and abuse of communications

  • bulk messaging without the consent of recipients (email, messengers, SMS, comments), harvesting of addresses for such messaging;
  • open mail relays and proxies, sender forgery;
  • outbound connections to ports 25 and 465 (SMTP) are blocked at the infrastructure level for all servers; for legitimate mail delivery use an authenticated SMTP relay on port 587 (STARTTLS). Inbound mail to your server is not filtered. If your task genuinely requires port 25 or 465, contact support — an exception is granted per server IP after review.

Abuse of resources and network

  • torrent traffic and other file-sharing distribution of content via P2P networks — blocked technically; storing and seeding unlicensed content via any protocol is prohibited;
  • cryptocurrency mining and other computations that create a constant full CPU load, on plans where this is not expressly permitted;
  • resource consumption that threatens denial of service to other customers on the same node;
  • public proxy and VPN services used to conceal unlawful activity; a VPN for personal use is permitted provided the remaining provisions of this Policy are complied with;
  • port scanning and any network activity that gives rise to complaints from third parties or upstream providers.

2.2. This list is not exhaustive. Anything that violates the laws of the country where the server is hosted, the rules of the upstream provider or the rights of third parties is prohibited, even if not expressly named above.

3. How to File a Complaint

3.1. Complaints about violations are accepted from rights holders and their representatives, affected persons, data subjects, upstream providers and competent authorities at abuse@doubleservers.com.

3.2. A complaint must make it possible to establish the violation. Please specify:

  • the IP address or domain name where the material is hosted or from which the violation originates;
  • a description of the violation and, where possible, evidence: logs with timestamps and time zone, links, screenshots;
  • the date and time of the violation;
  • your contact details and, for rights holders, proof of rights to the material.

3.3. If a complaint does not make it possible to establish the violation or its source, we request clarification and may refrain from taking action until it is received. Anonymous complaints without evidence are considered at our discretion.

3.4. Initial response to a complaint — within 24 hours of receipt on business days; for complaints about serious violations (sexual exploitation of minors, an active attack, phishing) — immediately upon confirmation.

4. Measures in Case of Violation

4.1. Measures are applied in proportion to the severity and recurrence of the violation. As a rule, the sequence is as follows:

  • a warning with a demand to remedy the violation within a specified period (usually 24 hours);
  • restriction — bandwidth reduction or network block: the server continues to run and is accessible via the console in the control panel, but network traffic is cut off until the violation is remedied;
  • freeze — the server is stopped until the violation is remedied and confirmation is received from the customer;
  • account suspension and termination of the agreement in the event of repeated or serious violations.

4.2. In the event of serious violations (clause 3.4), an active attack from the server, or at the request of an upstream provider or a competent authority, measures are applied immediately, without prior warning.

4.3. The customer is notified of the measures applied and their reason via the control panel, email or Telegram; the notification states what needs to be done to restore access.

4.4. The customer may submit objections at abuse@doubleservers.com or via a ticket in the control panel. If the violation is not confirmed, access is restored and the rental period is extended by the duration of the restriction. If the violation is confirmed, the period of restriction is neither compensated nor refunded.

4.5. Upon termination of the agreement for a violation, the server is deleted and its data and backups are destroyed 7 days after the customer is notified, unless otherwise required by a lawful request of a competent authority. A customer whose server has been frozen rather than deleted is given access to the data for download via the control panel or upon request to support within this period.

4.6. Payment for services terminated for violation of this Policy is not refunded — see the "Refunds" section of the Terms of Service. The customer shall compensate DoubleServers for documented losses caused by the violation: upstream provider penalties, the cost of blocked IP addresses, incident response costs.

5. Cooperation with Rights Holders and Authorities

5.1. Complaints from rights holders are handled in accordance with section 3. Upon a proper notice that makes it possible to identify the rights holder, the work and the location of the material, access to the material is restricted within the shortest technically feasible time. The customer is notified and may, within 5 business days, submit a counter-notice with evidence of the lawfulness of the hosting; if the rights holder does not confirm within 10 business days thereafter that they have applied to a court or an authorised body, access is restored. Repeated confirmed copyright infringements lead to termination of the agreement.

5.2. We disclose customer information to third parties only on the basis of a lawful request from a competent authority of the country where the server is hosted or of the country of our jurisdiction, made in the prescribed manner, or where disclosure is necessary to prevent an imminent threat to human life or health.

5.3. We record every complaint and the measures taken: date, time, source, substance, actions. These records are retained for at least 12 months and may be provided to competent authorities upon a lawful request.

5.4. Upon a lawful request from a competent authority, we preserve the logs and other information in our possession that relate to the investigation for the period specified in the request, within the limits established by law. We do not log or store the contents of customer servers; information about them can only be obtained from the server itself in the manner prescribed by law.

6. Liability and Final Provisions

6.1. DoubleServers does not pre-screen materials hosted by customers and is not responsible for their content. Responsibility for the content and the lawfulness of the use of the server rests entirely with the customer.

6.2. This Policy may be amended. Amendments are published on this page and take effect 7 days after publication; continued use of the services constitutes acceptance of the new version.
